FAIR Plan fair, for now

P-FAIRPLANINCOURT2007-12-10-1197347576.jpgState Supreme Court Justice Kenneth Fisher today dismissed two separate lawsuits against Monroe County, regarding passage of its so called FAIR plan.

The end result of the plan was a 50% reduction in the amount of sales tax revenue the County had previously shared with suburban school districts.

The judge dismissed one lawsuit, filed by the school districts, finding the county was within its legal right to reduce its aid to schools. Fisher also dismissed another suit filed by several educators who claimed the County Legislature, in hastily approving the FAIR plan back in September, violated the State Open Meetings Law by failing to give the public timely  notice of its intent to vote on the issue.

Monroe County Executive Maggie Brooks told  News 8 Now, "This certainly validates our opinion that the FAIR plan is legally sound."

Representatives of area school districts previously indicated their intent to appeal, should the court rule against them.  

 They are expected to confirm their future plans on Tuesday.
