Virginia man admits to lying to get pain medication from Buffalo clinics

A 28 year old man from Virginia pleaded guilty today to felony charges obtaining controlled substances by fraud and lying to military personnel.

Assistant US Attorney MaryEllen Kresse, who handled the case, says Benjamin Moser obtained a fake active duty card from the Niagara Falls Air Force Base, saying that he was on active duty and presenting orders which he knew were no longer valid.

According to Kresse, Moser then went to emergency rooms and clinics throughout Buffalo seeking medical treatment and prescriptions for oxycodone and hydrocodone, which are pain medications.

Moser had a fake active duty card which if real, would make him eligible for healthcare benefits under TRICARE, a program which provides benefits to active duty service personnel.

Moser is scheduled to be sentenced on the felony charges in March.
