A retired Rochester Police captain is now being charged in his son's death.

Michael Leach, 59, is charged with second degree murder. The indictment was unsealed Wednesday morning. In it, Leach is accused of intentionally killing his son, Matthew Leach, 38. Police say last July Michael Leach shot his son at a motel in Old Forge. The bullet came from his Perry Police Department-issued gun, a .45 caliber handgun. He claimed he thought Matthew was an intruder.
