Major lawsuit concering Medicare and nursing homes to be heard in Rochester

A courtroom in Rochester will provide the arena for a massive lawsuit involving nursing homes from across New York who are suing the state over Medicaid reimbursement. More than 160 nursing homes have filed suit, claiming the state erred in calculating reimbursements since the Medicare Part-D prescription drug program went into effect in January of 2006 and while the state changed the formula just last month to more accurately provide reimbursement, the nursing homes claim it has refused to make up the difference for what they lost over the 20 months prior to that.
The amount in dispute is $60 million. The case will be heard here because the nursing homes hired the locally based lawfirm of Harter and Secrest.
