"Ian's Law" would make it illegal for insurance companies to drop entire lines of insurance as a pretext for denying coverage to individuals. The bill is named after 37-year-old Ian Pearl, who suffers from muscular dystrophy and needs around the clock care. Albany State Senator Neil Breslin, who's unveiling the law, says Guardian Health Care found a loophole that allowed them to cancel the entire class of insurance policies in the state. Guardian could not have legally dropped the family's policy under state law. The legislation would require insurance carriers to get prior approval from the state Insurance Department before eliminating a class of insurance. |
